1. Introduction

By accessing or purchasing from Radioactiverock.com / Dirt Treasure, LLC (“The Company”), you agree to these Terms and Conditions. You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction) to enter into this agreement.

2. Definitions

For purposes of these Terms and Conditions:
“Affiliates” means any entity that directly or indirectly controls, is controlled by, or is under common control with the Company.
“Contractors, suppliers, representatives, agents, and volunteers” means individuals or organizations engaged by, assisting, or authorized by the Company to provide services, logistics, handling, photography, hosting, packaging, advice, or related functions, whether compensated or uncompensated, and whether or not they possess formal education, professional certification, or specific technical training in any field related to the Company’s activities or the assistance and services they provide. Their participation does not constitute professional, licensed, or certified oversight, advice, or representation.
“Good-faith belief” means an honest and reasonable belief based on known facts and applicable law at the time a decision or disclosure is made.
“Recognized radiation-safety guidelines” refers to those issued or endorsed by competent authorities such as the U.S. Nuclear Regulatory Commission (NRC), the International Atomic Energy Agency (IAEA), or an equivalent regulatory body in the purchaser’s jurisdiction.

3. Product Information

PRODUCTS OFFERED INCLUDE NATURALLY OCCURRING RADIOACTIVE MATERIALS (NORM) AND VINTAGE ARTIFACTS CONTAINING RADIOACTIVE ELEMENTS. THESE MATERIALS EMIT CERTAIN LEVELS OF IONIZING RADIATION. PURCHASERS ACKNOWLEDGE THEY UNDERSTAND, ACCEPT, AND ASSUME ALL INHERENT RISKS OF ACQUIRING, HANDLING, USING, STORING, AND OWNING SUCH MATERIALS. THE COMPANY MAKES NO REPRESENTATION THAT ANY PRODUCT IS EXEMPT FROM LICENSING OR REGISTRATION REQUIREMENTS IN ANY JURISDICTION.
PRODUCTS ARE OFFERED AS NATURALLY OCCURRING SPECIMENS AND ARE NOT INTENDED OR REPRESENTED AS LICENSED RADIOACTIVE SOURCES. PURCHASERS ARE SOLELY RESPONSIBLE FOR ENSURING COMPLIANCE WITH ALL APPLICABLE LAWS AND REGULATIONS IN THEIR JURISDICTION. PRODUCTS ARE SOLD “AS-IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Intended Use:

All products offered by the Company are sold strictly for lawful purposes of scientific study, education, historical preservation, collection, or geological interest. They are not intended for use in manufacturing, medical, nuclear, or radiological applications, or for any activity regulated under the radiological-control, hazardous-materials, or nuclear-safety laws of any jurisdiction. Purchasers agree to comply with all applicable laws and regulations in both their country of residence and the country of origin. All items are provided as collectible and educational specimens only.
 

Product Descriptions:

All product descriptions, photographs, weights, sizes, color representations are provided in good-faith belief but are approximate and may vary. The Company does not guarantee absolute accuracy of measurements, coloration, or appearance due to the natural variation of materials and differences in lighting, photography, or display screens. Purchasers accept that variations do not constitute defects or grounds for claims beyond those provided in the Returns and Refunds section.
 

Radioactivity Measurements:

Any radiation activity values provided (including µSv/hr, CPM, CPS, or Bq) are approximate and depend on the measurement method, instrument, calibration, time and distance. Purchasers acknowledge that variations are expected and that provided values are for general reference only and are obtained using non-calibrated instruments. Differences in readings do not constitute defects or grounds for claims beyond those provided in the Returns and Refunds section. No statement or measurement provided by the Company shall be construed as a certification of safety, compliance, or regulatory exemption.

Information provided by the Company, whether on the website, product packaging, or in correspondence, is for general educational and reference purposes only and does not constitute professional, scientific, legal, or safety advice.

4. Shipping

We ship via USPS Parcel Select Ground only. A signature may be required. We do not ship to P.O. boxes, APO/FPO addresses, or outside the United States if the order contains any Class 7 radioactive specimen, sample, or item with uranium or thorium.

All shipments comply with U.S. export control laws. International purchasers bear sole responsibility for import compliance. Delivery times vary. Most orders arrive within 7 days, but the Company makes no guarantee of delivery by a specific date.

Shipping costs are charged at a flat rate of $7.50 per order within the continental U.S. Additional charges may apply for oversized shipments or deliveries to Alaska and Hawaii. Purchasers are also responsible for any applicable sales taxes, import duties, tariffs, or customs fees imposed by a governmental authority.

Countries excluded from shipping due to high loss of packages in transport: The Netherlands, Spain.

5. Returns and Refunds

Nothing in this section shall be interpreted as creating a warranty beyond those expressly stated. Purchasers may return items for safe disposal, subject to all applicable laws, regulations, and shipping requirements. In the United States, this includes compliance with NRC requirements. Specialized containers will be provided at cost.

Purchasers remain responsible for compliance with all return shipping requirements until the Company takes possession.

Claims for damaged or defective items must be made within 7 days of receipt. The Company may require photographic evidence and reserves the right to issue a refund or replacement at its discretion.

Absolutely no refunds once order is placed. Refunds will only be disbursed if a mistake was on the company's part. The company will not give refunds due to a customers change of mind or no longer wanting the item.

Product Availability:

All products are offered subject to availability. The Company reserves the right to cancel or refuse any order if an item is out of stock, incorrectly listed, or otherwise unavailable. In such cases, the purchaser will receive a full refund or the option to select a replacement.

6. Safe Handling and Storage

Purchasers are responsible for understanding and adhering to recognized radiation-safety guidelines and limits applicable in their jurisdiction. Keep materials out of reach of children and pets. Inform household members or property owners of ownership. Clearly label all specimens. Follow appropriate cleanup procedures in case of spills or breakage. Dispose of materials according to local law or return them to the Company.

IN THE EVENT OF INGESTION OR INHALATION BY HUMANS OR ANIMALS, SEEK IMMEDIATE EMERGENCY MEDICAL OR VETERINARY CARE.

7. Lawful and Responsible Use

Purchasers agree to use all products, materials, services, and information provided by the Company, its affiliates, contractors, suppliers, agents, representatives, and volunteers only for lawful purposes and in full compliance with all applicable local, national, and international laws and regulations, including those governing the possession, transport, import, export, or use of naturally occurring radioactive materials (NORM). Products shall not be used in any manner that violates environmental, health, safety, export-control, or radiological-safety laws or equivalent regulatory regimes. The Company and its affiliates, contractors, suppliers, agents, representatives, and volunteers disclaim any responsibility or liability arising from unlawful, negligent, or unauthorized use, possession, modification, or resale of its products or services.

8. Liability and Indemnification

IN ADDITION TO THE OBLIGATIONS SET FORTH IN SECTION 6, PURCHASERS ASSUME ALL RISKS, DIRECT OR INDIRECT, RELATED TO OWNERSHIP, STORAGE, AND HANDLING OF RADIOACTIVE MATERIALS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR PERSONAL INJURY, PROPERTY DAMAGE, LEGAL CONSEQUENCES, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THESE PRODUCTS. THIS LIMITATION DOES NOT APPLY TO LIABILITY RESULTING FROM THE COMPANY’S OWN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

PURCHASERS WAIVE ANY RIGHT OF RECOVERY AGAINST, AND AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE COMPANY, ITS OWNERS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AGENTS, REPRESENTATIVES, AND VOLUNTEERS FROM ANY CLAIMS, DAMAGES, LIABILITIES, COSTS, OR EXPENSES (INCLUDING ATTORNEY’S FEES) ARISING FROM THE PURCHASE, TRANSPORT, POSSESSION, HANDLING, USE, STORAGE, OR RESALE OF PRODUCTS, EXCEPT TO THE EXTENT SUCH CLAIMS RESULT SOLELY FROM THE COMPANY’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

In any event, the Company, its affiliates, contractors, suppliers, agents, representatives, and volunteers, combined total aggregate liability shall not exceed the purchase price paid for the product.​

9. Privacy and Data Protection

The Company collects and processes personal information (including names, contact details, payment information, and order history) solely for order fulfillment, customer service, and legal compliance.

We may use third-party service providers, including hosting companies, payment processors, shipping carriers, contractors, and agents, to process and store data on our behalf. These providers act under the Company’s instructions and are not liable for any claims arising from data processing.

Personal data is processed exclusively under the laws of the United States. The Company does not represent that its practices comply with GDPR, CCPA, or other foreign data protection regimes. By purchasing from the Company, you consent to this data collection and processing. International customers acknowledge that U.S. law may provide a different level of data protection than their local law. 10. Right to Refuse Service

The Company reserves the right to cancel or refuse any order if there is suspicion of unlawful, unethical, or unsafe use, or if the purchaser is underage, abusive, threatening, or otherwise acting in bad faith.

11. Governing Law and Dispute Resolution

At the time of any dispute these Terms and Conditions are governed by the state of Colorado. All disputes shall be resolved exclusively in the state or federal courts of that state, and purchasers consent to the jurisdiction and venue of those courts. For international purchasers, these Terms shall be construed under U.S. law, and any contrary mandatory consumer law shall apply only to the minimum extent required.​

12. Cooperation with Law Enforcement and Legal Requests

The Company will cooperate with lawful requests from law enforcement, regulators, or courts when it is required to do so by law. This may include disclosing transaction or contact information in response to a subpoena, court order, search warrant, or other legal process, or when the Company has a good-faith belief that such disclosure is necessary to comply with applicable law, prevent illegal activity, or protect the rights, property, or safety of the Company or others. Any disclosure made under this section shall not be considered a breach of the Company’s privacy obligations under these Terms.

13. Force Majeure

The Company shall not be liable for delays or failures caused by events outside its reasonable control, including natural disasters, governmental restrictions, supply chain disruptions, or transportation failures.

14. Changes

The Company reserves the right to amend these Terms without prior notice. Continued use of the website or purchase of products constitutes acceptance of any changes.

15. Severability and Survival

If any provision of these Terms and Conditions is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law. Any obligations relating to indemnification, limitations of liability, warranties and disclaimers, ownership rights, or confidentiality shall survive termination or expiration of these Terms. These Terms and Conditions, together with any order confirmation, constitute the entire agreement between the Company and the purchaser and supersede all prior understandings or representations, whether written or oral.
